Terms of Service
These terms govern your use of Vikka. By creating an account or using the service, you agree to them. Vikka is a compliance tool; it does not replace your own legal responsibility for the batteries you place on the market.
Agreement to these terms
These terms form an agreement between you (or the organization you represent) and Vikka. If you use Vikka on behalf of an organization, you confirm you are authorized to accept these terms for it. If you do not agree, do not use the service.
The service
Vikka is a platform for the EU Battery Regulation 2023/1542. It helps you turn product data into battery Digital Product Passports, scores completeness against the current rules, tracks enforcement deadlines, and generates the GS1 Digital Link QR code. The exact features may change as the platform and the regulation evolve.
Beta service
Vikka is offered during an onboarding and beta phase. Features may change, and we do not guarantee a particular uptime or availability during this phase. We may add, change or remove functionality, and we will aim to give reasonable notice of significant changes.
Accounts and eligibility
You need an account to use the platform. You are responsible for keeping your sign-in and any API keys secure, and for all activity under your account. Access is limited to business users; Vikka is not intended for consumers or for anyone under 18.
Your data and content
The product and passport data you upload or enter remains yours. You grant Vikka the limited right to process, store and display that data only as needed to provide the service, including publishing the legally public tier of a passport when you choose to publish it. You are responsible for having the right to submit the data you provide.
How we handle personal data is described in our Privacy Policy.
Compliance is your responsibility
Vikka helps you prepare and manage battery passports, but it does not make you compliant by itself and it does not provide legal advice. The accuracy and completeness of a passport depend on the data you provide. You remain responsible for meeting your obligations under the EU Battery Regulation and any other applicable law, and for verifying the output before you rely on it or publish it.
Acceptable use
You agree not to misuse the service. In particular, you will not:
- use Vikka for any unlawful purpose or to submit data you have no right to use;
- attempt to break, overload, probe or circumvent the platform's security or rate limits;
- reverse engineer, resell or provide the service to third parties except as the service intends;
- upload malware or content that infringes the rights of others.
API use
The API is accessed with per-organization keys that carry scopes (read and write) and are rate-limited. You are responsible for keeping keys secret and for traffic made with them. We may adjust rate limits or endpoints, and we will aim to keep the public API reference current.
Fees
Your first 50 passports are free. Beyond that, use is charged per passport (currently 0.20 euro per passport). Prices and free allowances may change; we will give notice of changes before they apply to you. Taxes may apply depending on your location.
Third-party services
Vikka relies on infrastructure providers (such as cloud hosting, automated data extraction and email delivery) to run the service. We are not responsible for outages or actions of those providers beyond our reasonable control, though we choose them with care and bind them by agreement.
Intellectual property
Vikka, including its software, design, rules engine and brand, belongs to us. These terms do not transfer any of our intellectual property to you. You keep all rights in your own data and content.
No warranty
The service is provided "as is" and "as available", especially during the beta phase. To the extent permitted by law, Vikka disclaims all implied warranties, including fitness for a particular purpose and that the service will be uninterrupted, error-free or that any compliance score guarantees a legal outcome.
Limitation of liability
To the extent permitted by law, Vikka is not liable for indirect, incidental or consequential damages, or for lost profits, data or goodwill. Nothing in these terms excludes liability that cannot be excluded by law. The precise liability cap will be set in the final commercial agreement; until then, the service is used on a beta basis.
Termination
You may stop using Vikka and close your account at any time. We may suspend or end access if you breach these terms or use the service in a way that risks harm to the platform or others. On termination you can request export or deletion of your account data, subject to any legal retention duties.
Changes to these terms
We may update these terms as the platform and the regulation evolve. The date at the top shows the last change. If a change is material, we will communicate it through the service. Continued use after a change means you accept the updated terms.
Governing law
These terms are governed by the law of the Netherlands, and disputes are subject to the competent Dutch courts, unless mandatory law in your country provides otherwise. The exact governing entity and jurisdiction will be confirmed in the final commercial agreement.
